PROVIDING NEAREST OTHER LOCALITY PAY RATE 1 FOR CERTAIN BUREAU OF PRISONS EMPLOY- 2 EES RECEIVING REST OF U.S. LOCALITY 3 RATE. 4 Section 5304 of title 5, United States Code, is 5 amended by redesignating subsection (i) as subsection (j) 6 and by inserting after subsection (h) the following: 7 ‘‘(i)(1) Notwithstanding any other provision of this 8 chapter, and consistent with paragraph (2), the official 9 worksite of an employee of the Bureau of Prisons that is 10 otherwise located in the pay locality designated as ‘Rest 11 of U.S.’ shall be considered to be located in the nearest 12 other pay locality established pursuant to this section. 13 ‘‘(2) For purposes of carrying out paragraph (1)— 14 ‘‘(A) if more than one pay locality is within 200 15 miles of the official worksite of such an employee, 16 such worksite shall be considered to be located in the 17 pay locality with the highest comparability payment; 18 ‘‘(B) an employee of the Bureau of Prisons 19 shall not be subject to paragraph (1) if the official 20 worksite of such employee is not within 200 miles of 21 any pay locality other than ‘Rest of U.S.’; and 22 ‘‘(C) notwithstanding any other provision of 23 law, the term ‘employee’ includes any prevailing rate 24 employee (as that term is defined ins section 5342). 25 VerDate Sep 11 2014 04:11 May 20, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3199.IH H3199 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3199 IH ‘‘(3) This subsection shall begin to apply during any 1 pay period beginning on or after the date that is 180 days 2 after the date of enactment of this subsection.’’. 3 Æ VerDate Sep 11 2014 04:11 May 20, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3199.IH H3199 kjohnson on DSK79L0C42PROD with BILLS
