  89R1994 DRS-D     By: Schofield H.B. No. 5514       A BILL TO BE ENTITLED   AN ACT   relating to the authority of a municipality or county to allow the   construction of multifamily housing in certain areas.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Chapter 250, Local Government Code, is amended   by adding Section 250.014 to read as follows:           Sec.   250.014.     REGULATIONS RELATED TO CONSTRUCTION OF   MULTIFAMILY HOUSING IN CERTAIN RESIDENTIAL AREAS. (a)     Notwithstanding any other law, a municipality or county may not   adopt or enforce an ordinance, order, zoning variance, or other   regulation that allows for the construction of a multifamily   housing unit in an area that consists predominantly of single   family residences.           (b)     A person aggrieved by a violation of Subsection (a) may   bring an action for economic damages or injunctive relief against a   municipality or county.           (c)     A person who prevails in an action under this section is   entitled to recover treble damages.           (d)     Governmental immunity of a municipality or county to   suit and from liability is waived to the extent of liability created   by this section.          SECTION 2.  This Act takes effect September 1, 2025.
