  89R26795 MCK-F     By: Capriglione H.B. No. 5469     Substitute the following for H.B. No. 5469:     By:  Capriglione C.S.H.B. No. 5469       A BILL TO BE ENTITLED   AN ACT   relating to the effect of provisions of laws enacted during the   regular session of the 89th Legislature requiring certain state   agencies to create reports.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  DEFINITION. In this Act, "report" means an ad   hoc or periodic publication, study, compilation of information,   statement, or written work product produced by an agency in the   executive or judicial branch of state government for distribution   to:                (1)  the legislature or an agency in the legislative   branch of state government; or                (2)  an officer or agency in the executive branch of   state government.          SECTION 2.  ABOLITION OF REPORTS. Except as otherwise   specifically provided by this Act, an agency in the executive or   judicial branch of state government is not required to create a   report if an Act of the 89th Legislature, Regular Session, 2025,   that becomes law creates the reporting requirement.          SECTION 3.  EXEMPT REPORTS; REPORTS REQUIRED BY FEDERAL LAW.   (a) Section 2 of this Act does not apply to a report required by the   following legislation:                (1)  H.B. No. 2 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to public education   and public school finance;                (2)  H.B. No. 6 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to discipline in   public schools;                (3)  H.B. No. 12 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the review and   audit of certain state agency operations;                (4)  H.B. No. 18 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the establishment   and administration of certain programs and services providing   health care services to rural counties;                (5)  H.B. No. 26 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to requiring   contracts with Medicaid managed care organizations to permit the   organizations to offer nutrition support services in lieu of other   state Medicaid plan services;                (6)  H.B. No. 29 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to water losses   reported by certain municipally owned utilities to the Texas Water   Development Board; authorizing administrative penalties;                (7)  H.B. No. 35 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to a peer support   network for first responders;                (8)  H.B. No. 36 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the monitoring of   certain family violence offenders, the provision of resources for   family violence victims, and the collection of information about   conditions of bond imposed in family violence cases and certain   other criminal cases;                (9)  H.B. No. 38 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to improvements to the   Texas Information and Referral Network;                (10)  H.B. No. 107 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the establishment   of the sickle cell disease registry;                (11)  H.B. No. 112 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the creation and   operation of a science park district in certain counties;                (12)  H.B. No. 114 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the transition of   certain veterans' mental health initiatives from the Texas Health   and Human Services Commission to the Texas Veterans Commission;                (13)  H.B. No. 118 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the establishment   and powers and duties of the Texas Advisory Committee on   Geopolitical Conflict;                (14)  H.B. No. 121 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to measures for   ensuring public school safety, including the commissioning of peace   officers by the Texas Education Agency, the composition of the   board of directors of the Texas School Safety Center, public school   safety and security requirements and resources, and the reporting   of child abuse or neglect by public school employees;                (15)  H.B. No. 140 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the creation of the   child and adult protective investigations advisory committee in the   Department of Family and Protective Services;                (16)  H.B. No. 141 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the adoption of the   revised Interstate Compact for the Placement of Children by the   State of Texas; making conforming changes;                (17)  H.B. No. 149 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to regulation of the   use of artificial intelligence systems in this state; providing   civil penalties;                (18)  H.B. No. 150 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the establishment   of the Texas Cyber Command as a component institution of The   University of Texas System and the transfer to it of certain powers   and duties of the Department of Information Resources;                (19)  H.B. No. 500 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to making   supplemental appropriations and reductions in appropriations and   giving direction and adjustment authority regarding   appropriations;                (20)  H.B. No. 1500 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the continuation   and functions of the Department of Information Resources, including   the composition of the governing body of the department;                (21)  H.B. No. 3526 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to fiscal   transparency for bonds issued by local governmental entities;                (22)  H.B. No. 3770 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to efficiency and   strategic fiscal reviews of state agencies conducted by the   Legislative Budget Board;                (23)  H.B. No. 3963 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to an early childhood   integrated data system;                (24)  S.B. No. 2 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the establishment   of an education savings account program; or                (25)  S.B. No. 5 or similar legislation of the 89th   Legislature, Regular Session, 2025, relating to the creation of the   Dementia Prevention and Research Institute of Texas.          (b)  Section 2 of this Act does not apply to a report created   by an Act of the 89th Legislature, Regular Session, 2025, that   becomes law if an agency in the executive or judicial branch of   state government is required to create the report to comply with   federal law.          SECTION 4.  EFFECT OF ACT. (a) This Act prevails over any   provision of another Act of the 89th Legislature, Regular Session,   2025, that becomes law that purports to require an agency in the   executive or judicial branch of state government to create a   report, regardless of the relative dates of enactment.          (b)  An exemption from the application of this Act contained   in another Act of the 89th Legislature, Regular Session, 2025, has   no effect.          SECTION 5.  EFFECTIVE DATE. This Act takes effect   immediately if it receives a vote of two-thirds of all the members   elected to each house, as provided by Section 39, Article III, Texas   Constitution.  If this Act does not receive the vote necessary for   immediate effect, this Act takes effect September 1, 2025.
