  89R16116 EAS-D     By: Leach H.B. No. 5354       A BILL TO BE ENTITLED   AN ACT   relating to the information reported by prosecuting attorneys to   the Texas Judicial Council.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter C, Chapter 71, Government Code, is   amended by adding Section 71.0354 to read as follows:           Sec.   71.0354.     PROSECUTING ATTORNEY INFORMATION. (a) In   this section, "prosecuting attorney" means a county attorney,   district attorney, or criminal district attorney representing this   state in criminal matters before the district or other courts of the   county.           (b)     Each prosecuting attorney shall report in the form and   manner prescribed by the council information on:                 (1)     the categories of criminal offenses prosecuted by   the prosecuting attorney and the number of criminal cases in each   category;                 (2)     the number of personnel employed by the   prosecuting attorney and whether that number is sufficient to   support the prosecutor's caseload;                 (3)     the number of times a defendant was released as   provided by Article 17.151, Code of Criminal Procedure; and                 (4)     the number of electronic notices submitted by the   prosecuting attorney to a court as required by Article   17.027(a)(2), Code of Criminal Procedure.           (c)     In prescribing the information to be submitted and form   and manner of submission of the information under Subsection (b),   the council shall consult with:                 (1)     the Texas District and County Attorneys   Association; and                 (2)  other interested persons.          SECTION 2.  Not later than September 1, 2026, the Texas   Judicial Council shall prescribe the information, and form and   manner of submission, a prosecuting attorney in this state is   required to report under Section 71.0354, Government Code, as added   by this Act.          SECTION 3.  This Act takes effect September 1, 2025.
