      By: Leach H.B. No. 4713       A BILL TO BE ENTITLED   AN ACT   relating to amending the Texas General Arbitration Act.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 16.073, Subchapter D, Chapter 16, Civil   Practice and Remedies Code, is amended by striking Subsections (a)   and (b) and substituting the following:          Sec. 16.073.  APPLICABILITY OF LIMITATIONS PERIODS TO   ARBITRATION. A claim sought to be arbitrated is subject to the same   limitations of time for the commencement of actions as if the claims   had been asserted in a court.   Commencing an action by filing suit   in a court of competent jurisdiction will serve to toll limitations   of time for binding arbitration of the same action.          SECTION 2.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution. If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect on the 91st day after the last day of the   legislative session.
