      By: Reynolds H.B. No. 3927       A BILL TO BE ENTITLED   AN ACT   relating to the consideration of certain local government actions   before the renewal of air permits for certain concrete plants.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter C, Chapter 382, Health and Safety   Code, is amended by adding Section 382.051955 to read as follows:           Sec.   382.051955.     STANDARD PERMIT FOR CONCRETE BATCH PLANTS:   CONSIDERATION OF LOCAL GOVERNMENT ACTION BEFORE RENEWAL.   (a)   This   section applies only to the renewal of an authorization to use a   standard permit issued under Section 382.05195 for the operation of   a permanent concrete plant that performs wet batching, dry   batching, or central mixing.             (b)     In determining whether and under which conditions to   renew an authorization described by Subsection (a), the commission   shall, while classifying the applicant's compliance history under   Section 5.754, Water Code, consider any civil suit instituted and   any other enforcement actions taken by a local government against   the applicant under Chapter 7, Water Code.          SECTION 2.  Section 382.051955, Health and Safety Code, as   added by this Act, applies only to an application for a renewal of   an authorization to use a standard permit that is submitted to the   Texas Commission on Environmental Quality on or after the effective   date of this Act.          SECTION 3.  This Act takes effect September 1, 2025.
