  89R16033 MM-D     By: Schatzline H.B. No. 3854       A BILL TO BE ENTITLED   AN ACT   relating to the reporting of child abuse or neglect.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 261.103, Family Code, is amended by   amending Subsection (a) and adding Subsections (a-1) and (d) to   read as follows:          (a)  Except as otherwise provided by this section   [ Subsections (b) and (c) ] and Section 261.405, a report shall be   made to:                (1)  any local or state law enforcement agency; and                (2)  the department .           (a-1)     If the alleged abuse or neglect occurred in a facility   operated, licensed, certified, or registered by a state agency, a   report may be made to [ ; or                [ (3) ]  the state agency that operates, licenses,   certifies, or registers the facility in which the alleged abuse or   neglect occurred in addition to the entities listed under   Subsection (a) .           (d)     A report must be made to the Texas Education Agency in   addition to the entities listed under Subsection (a) if the report   is based on alleged or suspected abuse or neglect that occurred at a   public school.          SECTION 2.  Section 261.103(c), Family Code, is repealed.          SECTION 3.  This Act takes effect September 1, 2025.
