  89R6223 JCG-D     By: Bhojani H.B. No. 3128       A BILL TO BE ENTITLED   AN ACT   relating to retirees of the Teacher Retirement System of Texas who   resume certain employment with a school district.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 825.4092(e), Government Code, is amended   to read as follows:          (e)  The amounts required to be paid under Subsections (b)   and (c) are not required to be paid by a reporting employer for a   retiree who retired from the retirement system :                 (1)    before September 1, 2005 ; or                 (2)     on or after September 1, 2005, if the retiree is   employed by a school district experiencing a teacher shortage, as   determined by the Texas Education Agency .          SECTION 2.  The changes in law made by this Act apply to a   retiree of the Teacher Retirement System of Texas regardless of   whether the person retired from employment before, on, or after the   effective date of this Act.          SECTION 3.  The changes in law made by this Act apply   beginning with the 2025-2026 school year.          SECTION 4.  This Act takes effect immediately if it receives   a vote of two-thirds of all the members elected to each house, as   provided by Section 39, Article III, Texas Constitution.  If this   Act does not receive the vote necessary for immediate effect, this   Act takes effect September 1, 2025.
