      By: Cain H.B. No. 2335       A BILL TO BE ENTITLED   AN ACT   relating to the effect of the amendment of certain documents   incorporated by reference into the laws or policy of this state on   related state agency rules.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Subchapter A, Chapter 2001, Government Code, is   amended by adding Section 2001.008 to read as follows:           Sec.   2001.008.     EFFECT OF AMENDMENT OF DOCUMENTS   INCORPORATED BY REFERENCE ON CERTAIN RULES. A state agency in the   manner provided by this chapter shall readopt, readopt with   amendments, or repeal a previously adopted rule if:                 (1)     the rule implements, interprets, or prescribes a   law or policy of this state that incorporates by reference a   document that is not another law or policy of this state; and                 (2)     as a result of an amendment to the document that is   incorporated by reference into the law or policy the rule   implements, interprets, or prescribes, the rule would:                       (A)     allow the agency to expand its regulatory   authority over a matter that involves a question of state policy; or                       (B)     impose a greater economic burden on persons   required to comply with the rule or on the economy of this state.          SECTION 2.  This Act takes effect September 1, 2025.
