  89R1773 ANG/MCF-D     By: Isaac H.B. No. 2268       A BILL TO BE ENTITLED   AN ACT   relating to the authority of the Texas Commission on Environmental   Quality to create certain special districts.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 42.042, Local Government Code, is   amended by adding Subsection (f-1) to read as follows:           (f-1)     The authority of the Texas Commission on   Environmental Quality to allow the creation or confirmation of a   municipal management district, municipal utility district, water   improvement district, or water control and improvement district,   master district, or subdistrict in the extraterritorial   jurisdiction of a municipality under Subsection (f) expires   September 1, 2025.          SECTION 2.  Subchapter B, Chapter 375, Local Government   Code, is amended by adding Section 375.027 to read as follows:           Sec.   375.027.     COMMISSION AUTHORITY TO CREATE DISTRICT. The   commission's authority to create a district by order under this   chapter expires September 1, 2025.          SECTION 3.  Subchapter B, Chapter 51, Water Code, is amended   by adding Section 51.053 to read as follows:           Sec.   51.053.     COMMISSION AUTHORITY TO CREATE DISTRICT OR   MASTER DISTRICT. The commission's authority to create a   multi-county district, district with the powers provided by Section   51.331, or master district by order under this chapter expires   September 1, 2025.          SECTION 4.  Section 51A.003, Water Code, is amended by   adding Subsection (j) to read as follows:           (j)     The commission's authority to create a subdistrict   under this chapter expires September 1, 2025.          SECTION 5.  Subchapter B, Chapter 54, Water Code, is amended   by adding Section 54.038 to read as follows:           Sec.   54.038.     COMMISSION AUTHORITY TO CREATE DISTRICT. The   commission's authority to create a district by order under this   chapter expires September 1, 2025.          SECTION 6.  Subchapter B, Chapter 55, Water Code, is amended   by adding Section 55.0465 to read as follows:           Sec.   55.0465.     MULTI-COUNTY DISTRICT: EXPIRATION OF   CREATION AUTHORITY. The authority of the commission and   commissioners courts to create a multi-county district under this   chapter expires September 1, 2025.          SECTION 7.  (a) Notwithstanding the changes in law made by   this Act, a petition for the creation of a district, master   district, or subdistrict pending before the Texas Commission on   Environmental Quality on the effective date of this Act is governed   by the law in effect on the date the petition was filed, and the   former law is continued in effect for that purpose.          (b)  The changes in law made by this Act do not affect the   validity of a district, master district, or subdistrict created by   the Texas Commission on Environmental Quality before September 1,   2025.          SECTION 8.  This Act takes effect September 1, 2025.
