COHEN, Ms. NORTON, Mr. SAN NICOLAS, Ms. HAALAND, Mr. COOPER,
Mr. LYNCH, Mr. COURTNEY, Mr. CICILLINE, Ms. VELA´ZQUEZ, and Mr.
MORELLE) introduced the following bill; which was referred to the Com-
mittee on Ways and Means, and in addition to the Committees on Edu-
cation and Labor, Small Business, and Financial Services, for a period
to be subsequently determined by the Speaker, in each case for consider-
ation of such provisions as fall within the jurisdiction of the committee
concerned

To promote arts, culture, and humanities.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Culture, Arts, Librar-
4
ies, and Museums Emergency Relief Act of 2020’’ or as
5
the ‘‘CALMER Act of 2020’’.

SEC. 2. APPROPRIATIONS FOR ARTS, CULTURE, AND HU-

MANITIES.

(a) NATIONAL ENDOWMENT FOR THE ARTS.—There
3
is hereby appropriated, out of any amounts in the Treas-
4
ury not otherwise appropriated, $4,000,000,000 for an ad-
5
ditional amount for the ‘‘Department of Health and
6
Human Services—National Foundation On The Arts And
7
Humanities—National Endowment For The Arts—grants
8
and administration’’ account, to be merged with and sub-
9
ject to the same conditions as amounts made available to
10
such account by division B of the Coronavirus Aid, Relief,
11
and Economic Security Act (Public Law 116–136).

(b) NATIONAL
ENDOWMENT
FOR
THE
HUMAN-

ITIES.—There is hereby appropriated, out of any amounts
14
in
the
Treasury
not
otherwise
appropriated,

$4,000,000,000 for an additional amount for the ‘‘Depart-

tions as amounts made available to such account by divi-

sion B of the Coronavirus Aid, Relief, and Economic Secu-

rity Act.

ICES.—There is hereby appropriated, out of any amounts

and administration’’ account, to be merged with and sub-

ject to the same conditions as amounts made available to

such account by division B of the Coronavirus Aid, Relief,

and Economic Security Act.

(d) USE OF FUNDS.—Amounts appropriated by sub-
8
sections (a) through (c) of this section may be made avail-
9
able in accordance with such subsections for any purpose
10
for which amounts under the respective headings were
11
made available by the Coronavirus Aid, Relief, and Eco-
12
nomic Security Act to prevent, prepare for, and respond
13
to coronavirus, including through grants to States, muse-
14
ums, territories, and tribes—
15
(1) to expand digital network access;
16
(2) to purchase tablets and other internet-en-
17
abled devices;
18
(3) to provide technical support services;
19
(4) to assist museums with operational ex-
20
penses;
21
(5) to develop and share distance learning con-
22
tent; and
23
(6) for pandemic recovery planning and imple-
24
mentation.

(e) ELIGIBILITY FOR FUNDING.—
1
(1) IN GENERAL.—An applicant for a grant or
2
other form of funding for which amounts are made
3
available from any account listed in subsections (a)
4
through (c) of this section may not be determined to
5
be ineligible to receive such grant solely—
6
(A) as a result of a prior rejection for such
7
grant; or
8
(B) by reason of not having previously re-
9
ceived a grant or other form of funding made
10
available from any such account.
11
(2) RECONSIDERATION.—The Chair of the Na-
12
tional Endowment for the Arts, the Chair of the Na-
13
tional Endowment for the Humanities, and the
14
Chair of the Institute of Museum and Library Serv-
15
ices shall take such steps as may be necessary to re-
16
consider each application for a grant or other form
17
of funding—
18
(A) that was submitted on or after the
19
date of the enactment of the Coronavirus Aid,
20
Relief, and Economic Security Act; and
21
(B) that was rejected solely as a result of
22
insufficient amounts available to accept such
23
application.

SEC. 3. EXPANSION OF ABOVE-THE-LINE DEDUCTION FOR
1
CHARITABLE CONTRIBUTIONS.
2
(a) REPEAL
OF
DOLLAR
LIMITATION.—Section
3
62(a)(22) of the Internal Revenue Code of 1986 is amend-
4
ed by striking ‘‘(not to exceed $300)’’.
5
(b) EXTENSION TO ADDITIONAL TAXABLE YEARS.—
6
Section 62(a)(22) of such Code is amended by striking
7
‘‘2020’’ and inserting ‘‘2019, 2020, or 2021’’.
8
(c) EFFECTIVE DATE.—The amendments made by
9
this section shall apply to taxable years beginning after
10
December 31, 2018.
11
SEC. 4. EXTENSION OF MODIFICATION OF LIMITATION ON
12
CHARITABLE CONTRIBUTIONS.
13
(a) IN GENERAL.—Section 2205(a)(3)(A)(i) of the
14
CARES Act is amended by inserting ‘‘or 2021’’ after
15
‘‘2020’’.
16
(b) EFFECTIVE DATE.—The amendment made by
17
this section shall apply to contributions made after De-
18
cember 31, 2020.

SEC. 5. PAYROLL TAX HOLIDAY FOR NONPROFIT ORGANI-
20
ZATIONS.
21
(a) IN GENERAL.—Subsections (a) and (b) of section
22
3111 of the Internal Revenue Code of 1986 shall not apply
23
with respect to any wages paid during calendar year 2020
24
by any organization described in section 501(c)(3) of such

Code and exempt from tax under section 501(a) of such

Code.

(b) TRUST FUNDS HELD HARMLESS.—The amounts
3
appropriated or transferred to any trust fund shall be de-
4
termined without regard to subsection (a).
5
SEC. 6. INCLUSION OF NONPROFIT ORGANIZATIONS IN THE
6
MAIN STREET LENDING PROGRAM.
7
The Board of Governors of the Federal Reserve Sys-
8
tem shall issue rules relating to the Main Street Lending
9
Program of the Board of Governors of the Federal Re-
10
serve System to ensure that nonprofit organizations de-
11
scribed in section 501(c) of the Internal Revenue Code and
12
exempt from tax under section 501(a) of such Code—
13
(1) are eligible to receive a loan under such
14
Program, where such loan is not subject to a min-
15
imum loan size; and
16
(2) are eligible for forgiveness of the amount of
17
any loan received under such Program.
18
SEC. 7. INCLUSION OF ALL NONPROFIT ORGANIZATIONS IN
19
THE PAYCHECK PROTECTION PROGRAM.
20
Section 7(a)(36)(A)(vii) of the Small Business Act
21
(15 U.S.C. 636(a)(36)(A)(vii)) is amended by striking
22
‘‘section 501(c)(3)’’ and inserting ‘‘section 501(c)’’.
