Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. EVALUATION AND REPORTING ON IMPROVING MAN- 1 AGEMENT OF DEPARTMENT OF ENERGY. 2 (a) IN GENERAL.—Part C of title VI of the Depart- 3 ment of Energy Organization Act (42 U.S.C. 7251 et seq.) 4 is amended by adding at the end the following new section: 5 ‘‘SEC. 664. EVALUATION AND REPORTING TO IMPROVE GEN- 6 ERAL MANAGEMENT. 7 ‘‘Not later than 1 year after the date of enactment 8 of this section, and every 2 years thereafter, the Secretary 9 shall submit to the Committee on Energy and Commerce 10 of the House of Representatives and the Committee on 11 Energy and Natural Resources of the Senate a report con- 12 taining— 13 ‘‘(1) an evaluation of the general management 14 of the Department, including management and mis- 15 sion support functional programs that have Depart- 16 ment-wide responsibility for legal services, adminis- 17 tration, accounting, budgeting, contract and project 18 management, human resources management, and 19 such other staff support offices the Secretary deter- 20 mines appropriate; 21 ‘‘(2) a description of impediments to effective 22 Departmental management; 23 ‘‘(3) a description of recommended measures to 24 improve Departmental management, including statu- 25 tory changes to address such impediments; 26 VerDate Sep 11 2014 22:57 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H8159.IH H8159 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 8159 IH ‘‘(4) a strategic plan, to be implemented by the 1 Office of the Secretary, for continuous improvement 2 in the management of the Department; and 3 ‘‘(5) an evaluation of the status of the improve- 4 ment of Departmental management.’’. 5 (b) CONFORMING AMENDMENT.—The table of con- 6 tents of the Department of Energy Organization Act is 7 amended by inserting after the item relating to section 8 663 the following: 9 ‘‘Sec. 664. Evaluation and reporting to improve general management.’’. SEC. 3. UPDATING ORDERS RELATING TO DEPARTMENT OF 10 ENERGY MANAGEMENT. 11 Not later than 1 year after the date of enactment 12 of this Act, the Secretary of Energy shall submit to the 13 Committee on Energy and Commerce of the House of 14 Representatives and the Committee on Energy and Nat- 15 ural Resources of the Senate a report containing— 16 (1) a description of the status of all orders 17 issued by the Department of Energy relating to 18 management of the Department; and 19 (2) a schedule for updating such orders to en- 20 sure effective management of the Department, in- 21 cluding personnel of the Department and budget for- 22 mulation. 23 VerDate Sep 11 2014 22:57 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H8159.IH H8159 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 8159 IH SEC. 4. INTEGRATION OF NATIONAL NUCLEAR SECURITY 1 ADMINISTRATION AND DEPARTMENT OF EN- 2 ERGY MISSION-SUPPORT PERSONNEL. 3 Section 3220 of the National Nuclear Security Ad- 4 ministration Act (50 U.S.C. 2410) is amended— 5 (1) by striking subsection (a) and inserting the 6 following new subsection: 7 ‘‘(a) STATUS OF ADMINISTRATION PERSONNEL.— 8 Each officer or employee of the Administration shall be 9 responsible to and subject to the authority, direction, and 10 control of the Secretary consistent with section 202(c)(3) 11 of the Department of Energy Organization Act (42 U.S.C. 12 7132(c)(3)).’’; 13 (2) by striking subsection (b); 14 (3) by redesignating subsections (c), (d), and 15 (e) as subsections (b), (c), and (d), respectively; 16 (4) in subsection (b), as so redesignated, by 17 striking ‘‘Subsections (a) and (b)’’ and inserting 18 ‘‘Subsection (a)’’; and 19 (5) in subsection (d), as so redesignated, by 20 striking ‘‘subsections (a) and (b)’’ and inserting 21 ‘‘subsection (a)’’. 22 Æ VerDate Sep 11 2014 22:57 Sep 04, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H8159.IH H8159 pbinns on DSKJLVW7X2PROD with BILLS
