Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. AUTHORITY TO PLACE CERTAIN RETIRED MEM- 1 BERS OF THE ARMED FORCES IN THE READY 2 RESERVE; PAY. 3 (a) PLACEMENT OF CERTAIN MEMBERS IN THE 4 READY RESERVE.—Section 10145 of such title is amend- 5 ed by adding at the end the following new subsection: 6 ‘‘(e)(1) Under such regulations as the Secretary con- 7 cerned may prescribe, a retired member of a regular com- 8 ponent entitled to retired pay may be placed in the Ready 9 Reserve if the Secretary concerned— 10 ‘‘(A) determines that the retired member has 11 more than 20 years of creditable service in that reg- 12 ular component; and 13 ‘‘(B) makes a special finding that the member 14 possesses a skill in which the Ready Reserve of the 15 armed force concerned has a critical shortage of per- 16 sonnel. 17 ‘‘(2) The authority of the Secretary concerned under 18 paragraph (1) may not be delegated— 19 ‘‘(A) to a civilian officer or employee of the 20 military department concerned below the level of As- 21 sistant Secretary; or 22 ‘‘(B) to a member of the armed forces below 23 the level of the lieutenant general or vice admiral in 24 an armed force with responsibility for military per- 25 sonnel policy in that armed force.’’. 26 VerDate Sep 11 2014 02:49 Apr 18, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H6473.IH H6473 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 6473 IH (b) PAY FOR DUTIES PERFORMED IN THE READY 1 RESERVE IN ADDITION TO RETIRED PAY.—Section 2 12316 of title 10, United States Code, is amended— 3 (1) by adding at the end the following new sub- 4 section: 5 ‘‘(c) A member placed in the Ready Reserve pursuant 6 to section 10145(e) of this title may receive— 7 ‘‘(1) retired pay; and 8 ‘‘(2) the pay and allowances authorized by law 9 for duty that member performs.’’; and 10 (2) in subsection (a), by striking ‘‘subsection 11 (b)’’ and inserting ‘‘subsections (b) and (c)’’. 12 Æ VerDate Sep 11 2014 02:49 Apr 18, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H6473.IH H6473 kjohnson on DSK79L0C42PROD with BILLS
