A BILL
To preclude the transfer of Federal prisoners during the
emergency period described in section 1135(g)(1)(B) of
the Social Security Act, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Pausing All New De-
4
tention and Ending Movement of Inmates for Coronavirus
5
Act of 2020’’ or as the ‘‘PANDEMIC Act of 2020’’.

SEC. 2. PROHIBITION ON PRISONER TRANSFER.

During the emergency period described in section
8
1135(g)(1)(B) of the Social Security Act—

(1) notwithstanding section 3621 of title 18,
1
United States Code, no prisoner may be transferred
2
between correctional facilities;
3
(2) no individuals in the custody of the U.S.
4
Marshals Service shall be transferred to the custody
5
of the Bureau of Prisons for placement in a facility
6
operated by the Bureau of Prisons; and
7
(3) in the case of any person in the custody of
8
a State, pending transfer to the custody of the Bu-
9
reau of Prisons, the Attorney General may take such
10
actions as may be necessary to provide for the serv-
11
ice of any term of imprisonment by that person in
12
a correctional facility of that State.

SEC. 3. AUTHORITY FOR EXPANSION.

The Director of the Bureau of Prisons may take such
15
actions as may be necessary to expand capacity in any
16
correctional facility.

SEC. 4. WAIVER OF POWER.
18
The Attorney General may, on a case by case basis,
19
waive the application of section 2. The authority under
20
this section may not be delegated.
