A BILL
To provide contracting flexibility to small business concerns,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Easing Disruption for
4
America’s Small Contractor Act of 2020’’.
5
SEC. 2. SMALL BUSINESS CONTRACTING FLEXIBILITY.

(a) PURPOSE.—The purpose of this section is to pro-
7
vide flexibility to small business Federal suppliers and to
8
the Federal Government to more quickly award con-

tracting dollars to small business concerns in times of eco-
1
nomic uncertainty and downturn related to COVID–19.
2
(b) COVERED ENTITY DEFINED.—In this section, the
3
term ‘‘covered entity’’ means a small business concern
4
that is a party to a contract with a Federal agency and
5
experiences an adverse impact to the operations of the
6
small business concern as a result of COVID–19.

(c)
PROMOTION
OF
SMALL
BUSINESS
CON-
8
TRACTING.—

(1) SMALL BUSINESS CONTRACTING RELIEF.—
10
Notwithstanding any other provision of law or regu-
11
lation, during the period beginning on the date of
12
enactment of this section and ending on September
13
30, 2021, the head of the Federal agency with which
14
a covered entity has a contract shall provide the cov-
15
ered entity with—
16
(A) 90 additional days to carry out the re-
17
sponsibilities of the covered entity under the
18
contract; or
19
(B) an additional amount of time to carry
20
out the responsibilities of the covered entity
21
under the contract that the head of the Federal
22
agency determines to be appropriate after tak-
23
ing into consideration the severity of the ad-
24
verse impact experienced by the covered entity.

(2) PAYMENT CONTINUATION.—If the perform-
1
ance of all or any part of the work of a Federal
2
goods or services contract in force and effect during
3
the period beginning on the date of enactment of
4
this section and ending on September 30, 2021, is
5
unavoidably delayed or interrupted by the small
6
business contractor employees’ inability to access
7
Government facilities, systems, or other Govern-
8
ment-provided resources due to restrictions related
9
to COVID–19 that have been imposed by any au-
10
thority or due to orders or instructions issued by the
11
contracting agency in response to COVID–19, the
12
Government shall pay the small business contractor,
13
upon the submission of the documentation required
14
by the contract and according to the terms specified
15
in the contract, the prices stipulated in the contract
16
for goods or services as if the small business con-
17
tractor had rendered and the Government accepted
18
the goods or services. Contractor delivery schedules
19
shall be revised and small business contractors shall
20
be eligible for equitable adjustments based on the re-
21
vised schedules.
