SHORT TITLE. 3 This Act may be cited as the ‘‘Investing for the Peo- 4 ple Act of 2019’’. 5 TITLE I—BUDGET 6 ENFORCEMENT 7 SEC. 101. AMENDMENTS TO THE BALANCED BUDGET AND 8 EMERGENCY DEFICIT CONTROL ACT OF 1985. 9 (a) REVISED DISCRETIONARY SPENDING LIMITS.— 10 Section 251(c) of the Balanced Budget and Emergency 11 Deficit Control Act of 1985 (2 U.S.C. 901(c)) is amended 12 by striking paragraphs (7) and (8) and inserting the fol- 13 lowing: 14 ‘‘(7) for fiscal year 2020— 15 ‘‘(A) for the revised security category, 16 $664,000,000,000 in new budget authority; and 17 ‘‘(B) for the revised nonsecurity category, 18 $631,018,000,000 in new budget authority; and 19 ‘‘(8) for fiscal year 2021— 20 ‘‘(A) for the revised security category, 21 $680,119,000,000; and 22 ‘‘(B) for the revised nonsecurity category, 23 $646,056,000,000;’’. 24 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 4 HR 2021 RH (b) OVERSEAS CONTINGENCY OPERATIONS/GLOBAL 1 WAR ON TERRORISM ADJUSTMENT LIMIT.—Section 2 251(b)(2) of the Balanced Budget and Emergency Deficit 3 Control Act of 1985 (2 U.S.C. 901(b)(2)) is amended in 4 subparagraph (A) by inserting before the period at the end 5 the following: ‘‘, except that the adjustment for Overseas 6 Contingency Operations/Global War on Terrorism for fis- 7 cal year 2020 or any subsequent fiscal year shall not ex- 8 ceed $69,000,000,000 for the revised security category or 9 $8,000,000,000 for the revised nonsecurity category’’. 10 (c) NEW ADJUSTMENTS FOR THE INTERNAL REV- 11 ENUE SERVICE AND THE U.S. CENSUS FOR 2020.—Sec- 12 tion 251(b)(2) of the Balanced Budget and Emergency 13 Deficit Control Act of 1985 (2 U.S.C. 901(b)(2)) is 14 amended by adding at the end the following two new sub- 15 paragraphs: 16 ‘‘(G) INTERNAL REVENUE SERVICE TAX 17 ENFORCEMENT.— 18 ‘‘(i) IN GENERAL.—If a bill or joint 19 resolution making appropriations for a fis- 20 cal year is enacted that specifies an 21 amount in the Enforcement account and 22 the Operations Support account for tax en- 23 forcement activities, including tax compli- 24 ance to address the Federal tax gap, of the 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 5 HR 2021 RH Internal Revenue Service of the Depart- 1 ment of the Treasury, then the adjustment 2 for that fiscal year shall be the additional 3 new budget authority provided in that Act 4 for such purpose for that fiscal year, but 5 shall not exceed— 6 ‘‘(I) for fiscal year 2020, 7 $400,000,000; and 8 ‘‘(II) for fiscal year 2021, 9 $750,000,000. 10 ‘‘(ii) DEFINITION.—As used in this 11 subparagraph, the term ‘additional new 12 budget authority’ means the amount pro- 13 vided for a fiscal year, in excess of 14 $8,584,000,000, in an appropriation Act 15 and specified for tax enforcement activi- 16 ties, including tax compliance to address 17 the Federal tax gap, of the Internal Rev- 18 enue Service. 19 ‘‘(H) THE 2020 CENSUS.— 20 ‘‘(i) IN GENERAL.—If a bill or joint 21 resolution making appropriations for fiscal 22 year 2020 is enacted that specifies an 23 amount for the 2020 Census in the Peri- 24 odic Censuses and Programs account of 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 6 HR 2021 RH the Bureau of the Census of the Depart- 1 ment of Commerce, then the adjustment 2 for that fiscal year shall be the new budget 3 authority provided in that Act for such 4 purpose for fiscal year 2020, but shall not 5 exceed $7,500,000,000. 6 ‘‘(ii) DEFINITION.—As used in this 7 subparagraph, the term ‘new budget au- 8 thority’ means the amount provided for fis- 9 cal year 2020 in an appropriation Act and 10 specified to pay for expenses associated 11 with 2020 Census operations.’’. 12 (d) DIRECT SPENDING ADJUSTMENTS FOR FISCAL 13 YEARS 2020 AND 2021.—Section 251A of the Balanced 14 Budget and Emergency Deficit Control Act of 1985 (2 15 U.S.C. 901a), is amended— 16 (1) in paragraph (5)(B), in the matter pre- 17 ceding clause (i), by striking ‘‘and (12)’’ and insert- 18 ing ‘‘, (12), and (13)’’; and 19 (2) by adding at the end the following: 20 ‘‘(13) IMPLEMENTING DIRECT SPENDING RE- 21 DUCTIONS FOR FISCAL YEARS 2020 AND 2021.—(A) 22 OMB shall make the calculations necessary to imple- 23 ment the direct spending reductions calculated pur- 24 suant to paragraphs (3) and (4) without regard to 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 7 HR 2021 RH the amendment made to section 251(c) revising the 1 discretionary spending limits for fiscal years 2020 2 and 2021 by the Investing for the People Act of 3 2019. 4 ‘‘(B) Paragraph (5)(B) shall not be imple- 5 mented for fiscal years 2020 and 2021.’’. 6 TITLE II—ESTABLISHING A 7 CONGRESSIONAL BUDGET 8 SEC. 201. FISCAL YEAR 2020 BUDGET RESOLUTION. 9 (a) FISCAL YEAR 2020.—For the purpose of enforc- 10 ing the Congressional Budget Act of 1974 for fiscal year 11 2020, the allocations, aggregates, and levels provided for 12 in subsection (b) shall apply in the House of Representa- 13 tives in the same manner as for a concurrent resolution 14 on the budget for fiscal year 2020 with appropriate budg- 15 etary levels for fiscal year 2020 and for fiscal years 2021 16 through 2029. 17 (b) COMMITTEE ALLOCATIONS, AGGREGATES, AND 18 LEVELS.—In the House of Representatives, the Chair of 19 the Committee on the Budget shall submit a statement 20 for publication in the Congressional Record as soon as 21 practicable, containing— 22 (1) for the Committee on Appropriations, com- 23 mittee allocations for fiscal year 2020 consistent 24 with discretionary spending limits set forth in sec- 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 8 HR 2021 RH tion 251(c)(7) of the Balanced Budget and Emer- 1 gency Deficit Control Act of 1985, as amended by 2 this Act, and the outlays flowing therefrom, and 3 committee allocations for fiscal year 2020 for cur- 4 rent law mandatory budget authority and outlays, 5 for the purpose of enforcing section 302 of the Con- 6 gressional Budget Act of 1974; 7 (2) for all committees of that House other than 8 the Committee on Appropriations, committee alloca- 9 tions for fiscal year 2020 and for the period of fiscal 10 years 2020 through 2029 consistent with the most 11 recent baseline of the Congressional Budget Office, 12 as adjusted, to the extent practicable, for the budg- 13 etary effects of any provision of law enacted during 14 the period beginning on the date such baseline is 15 issued and ending on the date of submission of such 16 statement, for the purpose of enforcing section 302 17 of the Congressional Budget Act of 1974; 18 (3) aggregate spending levels for fiscal year 19 2020 in accordance with the allocations established 20 under paragraphs (1) and (2), for the purpose of en- 21 forcing section 311 of the Congressional Budget Act 22 of 1974; and 23 (4) aggregate revenue levels for fiscal year 2020 24 and for the period of fiscal years 2020 through 2029 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 9 HR 2021 RH consistent with the most recent baseline of the Con- 1 gressional Budget Office, as adjusted, to the extent 2 practicable, for the budgetary effects of any provi- 3 sion of law enacted during the period beginning on 4 the date such baseline is issued and ending on the 5 date of submission of such statement, for the pur- 6 pose of enforcing section 311 of the Congressional 7 Budget Act of 1974. 8 (c) ADDITIONAL MATTER.—The statement referred 9 to in subsection (b) may also include for fiscal year 2020, 10 the matter contained in the provisions referred to in sub- 11 section (e). 12 (d) ADJUSTMENTS.—The Chair of the Committee on 13 the Budget of the House of Representatives may adjust 14 the allocations, aggregates, and other budgetary levels in- 15 cluded in the statement referred to in subsection (b)— 16 (1) to reflect changes resulting from the Con- 17 gressional Budget Office’s updates to its baseline for 18 fiscal years 2020 through 2029; or 19 (2) for any bill, joint resolution, amendment, or 20 conference report by the amounts provided in such 21 measure if such measure would not increase the def- 22 icit for either of the following time periods: fiscal 23 year 2020 to fiscal year 2024 or fiscal year 2020 to 24 fiscal year 2029. 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 10 HR 2021 RH (e) APPLICATION.—Upon submission of the state- 1 ment referred to in subsection (b), all references to alloca- 2 tions, aggregates, or other appropriate levels in ‘‘this con- 3 current resolution’’ in sections 5201, 5202, and 5203 of 4 the House Concurrent Resolution 71 (115th Congress), 5 specified in section 30104(f)(1) of the Bipartisan Budget 6 Act of 2018, and continued in effect by section 103(m) 7 of House Resolution 6 (116th Congress), shall be treated 8 for all purposes in the House of Representatives as ref- 9 erences to the allocations, aggregates, or other appropriate 10 levels contained in the statement referred to in subsection 11 (b), as adjusted in accordance with this section or any 12 other Act. 13 SEC. 202. LIMITATION ON ADVANCE APPROPRIATIONS. 14 (a) IN GENERAL.—Except as provided in subsection 15 (b), any general appropriation bill or bill or joint resolu- 16 tion continuing appropriations, or amendment thereto or 17 conference report thereon, may not provide an advance ap- 18 propriation. 19 (b) EXCEPTIONS.—An advance appropriation may be 20 provided for programs, activities or accounts identified in 21 lists submitted for printing in the Congressional Record 22 by the Chair of the Committee on the Budget— 23 (1) for fiscal year 2021, under the heading ‘‘Ac- 24 counts Identified for Advance Appropriations’’ in an 25 VerDate Sep 11 2014 22:07 Apr 05, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H2021.RH H2021 kjohnson on DSK79L0C42 with BILLS 11 HR 2021 RH aggregate amount not to exceed $28,852,000,000 in 1 new budget authority, and for fiscal year 2022, ac- 2 counts separately identified under the same heading; 3 and 4 (2) for fiscal year 2021, under the heading 5 ‘‘Veterans Accounts Identified for Advance Appro- 6 priations’’ in an aggregate amount not to exceed 7 $87,636,650,000 in new budget authority. 8 (c) DEFINITION.—The term ‘‘advance appropriation’’ 9 means any new discretionary budget authority provided in 10 a general appropriation bill or bill or joint resolution con- 11 tinuing appropriations for fiscal year 2020, or any amend- 12 ment thereto or conference report thereon, that first be- 13 comes available following fiscal year 2020. 14 SEC. 203.
