HERRELL) introduced the following bill; which was referred to the Com-
mittee on the Judiciary
A BILL
To direct the head of each agency to repeal at least two
rules before adopting a proposed rule, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Cutting Unnecessary
4
Regulatory Burdens Act’’.

SEC. 2. REPEAL OF REGULATIONS REQUIRED BEFORE THE

ADOPTION OF A PROPOSED RULE.
2
(a) IN GENERAL.—Prior to, or at the time of, the
3
promulgation of any major rule, the head of an agency
4
shall repeal not less than 2 rules under the jurisdiction
5
of that agency to offset the costs of the major rule.
6
(b) INCREMENTAL COST ALLOWANCE.—The head of
7
an agency may not issue a rule that exceeds the total cost
8
of the rules identified for repeal unless required by law
9
or approved in writing by the Director of the Office of
10
Management and Budget.

(c) EXCEPTIONS.—This section shall not apply to any
12
rule related to the following:

(1) The Armed Forces.
14
(2) National security.
15
(3) The foreign affairs function of the United
16
States.
17
(4) Any major rule related to agency organiza-
18
tion, procedure, practice, management, or personnel.

(d) DEFINITIONS.—In this section:
20
(1) AGENCY.—The term ‘‘agency’’ has the
21
meaning given such term in section 551 of title 5,
22
United States Code.

(2) DIRECTOR.—The term ‘‘Director’’ means
24
the Director of the Office of Management and Budg-
25
et.
