A BILL
To direct the Secretary of Homeland Security to designate
the business of importing, manufacturing, or dealing fire-
arms, or importing or manufacturing ammunition pursu-
ant to section 923 of title 18, United States Code, as
a critical infrastructure sector, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Second Amendment
2
is Essential Act of 2021’’.

SEC. 2. CRITICAL INFRASTRUCTURE SECTOR AND WORK-

ERS.

(a) CRITICAL INFRASTRUCTURE SECTOR.—The Sec-
6
retary of Homeland Security shall designate the business
7
of importing, manufacturing, or dealing firearms, or im-
8
porting or manufacturing ammunition pursuant to section
9
923 of title 18, United States Code, as a critical infra-
10
structure sector (as such term is defined in section
11
1016(e) of the USA Patriot Act of 2001 (42 U.S.C.
12
5195c(e)).

(b) CRITICAL INFRASTRUCTURE WORKERS.—Indi-
14
viduals employed by entities designated as a critical infra-
15
structure sector pursuant to subsection (a) are critical in-
16
frastructure workers (as such term is defined in section
17
522 of the Homeland Security Act of 2002 (6 U.S.C.
18
321k)).
