Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Armed Forces Trans-
2
gender Dependent Protection Act’’.
3
SEC. 2. EXPANSION OF PROTECTIONS FOR TRANSGENDER
4
DEPENDENTS OF MEMBERS OF THE ARMED
5
FORCES UNDER THE EXCEPTIONAL FAMILY
6
MEMBER PROGRAM.

Section 1781c of title 10, United States Code, is
8
amended—
9
(1) in subsection (d)(3), by adding at the end
10
the following new subparagraph:
11
‘‘(F) Prohibition of assignment of such a mem-
12
ber (except at the election of such member) to a per-
13
manent duty location in a jurisdiction where foreign,
14
State, or local law restricts medically necessary
15
treatment for a medical or educational special need.
16
Such a member who is serving at a permanent duty
17
location in such a jurisdiction while such government
18
enacts a law establishing such restriction may, not
19
later than 30 days after such enactment, elect to be
20
reassigned by the Secretary concerned to a perma-
21
nent duty location not located in such a jurisdic-
22
tion.’’;

(2) in subsection (h), by striking ‘‘(as defined
24
by the Secretary in regulations for purposes of this
25
section)’’; and

(3) by adding at the end the following new sub-

section:

‘‘(i) MEDICAL OR EDUCATIONAL SPECIAL NEED DE-
3
FINED.—In this section, the term ‘medical or educational
4
special need’ includes the following:
5
‘‘(1) A potentially life-threatening or chronic
6
condition that requires—
7
‘‘(A) follow-up support more than once a
8
year; or
9
‘‘(B) specialty care.
10
‘‘(2) A current and chronic mental health condi-
11
tion.
12
‘‘(3) A frequent need for mental health care.
13
‘‘(4) Asthma or other chronic respiratory condi-
14
tion that includes wheezing.
15
‘‘(5) Gender dysphoria.
16
‘‘(6) A condition that requires—
17
‘‘(A) adaptive equipment;
18
‘‘(B) assistive technology devices or serv-
19
ices; or
20
‘‘(C) environmental or architectural consid-
21
erations.
22
‘‘(7) Special educational need.’’.
